弘石简讯(&English)|弘石律所赴柬完成驻柬滇企柬埔寨劳动法律培训

20231223日,云南弘石律师事务所汪卫平、惠乾在柬埔寨暹粒省云航投(柬埔寨)机场管理有限公司现场完成了主题为“中柬劳动法比较研习及驻柬滇企劳动用工法律风险管理探讨”的培训任务。

本次培训活动由云南省驻柬埔寨(金边)商务代表处、中国国际贸易促进委员会云南省分会主办,由云南弘石律师事务所、云航投(柬埔寨)机场管理有限公司承办。

活动开场,云南省驻柬埔寨(金边)商务代表处刘骁主任、中国国际贸易促进委员会云南省分会李仁贵秘书长、云南弘石律师事务所汪卫平主任相继致辞。本次培训同时通过线上会议的方式在金边、昆明设置了分会场,弘石律所培训项目团队其他成员在昆明线上参会。

主讲环节,汪卫平以中国贸促会(云南)南亚东南亚法律服务中心专家委员会专家身份,惠乾以汪卫平助理身份,作为本次培训的主讲人或助讲人,围绕着本次培训的原由、原则及柬埔寨劳动法概览,柬埔寨劳动法两个模块一个问题的具体规定,劳动用工法律风险管理探讨三个方面进行讲授。首先,由汪卫平就为什么会有这样的一次交流和探讨向听众进行了说明,基于国内国际经济大循环的需要、“一带一路”走深走实的需要、法律风险管理应当以人为本的需要,以及中柬两国深化传统友谊的需要,开展本次培训活动,正当其时。其次,汪卫平讲授了柬埔寨《劳动法》、中国《劳动法》与《劳动合同法》的概览以及中柬两国劳动法律的体例对比。接下来,汪卫平就域外法律学习研究应当反复求证,培训过程中的坚持与互动,为何要以专家身份而非律师身份开展本次培训交流进行了三点说明,并在讲述域外法律学习研究应当反复求证时,列举了培训准备过程中弘石律所通过不同来源、语言的文本进行综合求证,最终得出柬埔寨劳动法关于夜间和夜班工作具体规定的例子进行佐证,激发了与会听众的浓厚兴趣。其后,惠乾就柬埔寨劳动法关于劳动合同的订立、履行、暂止、解除,就劳动保护的重要规定,就劳动争议的解决途径向与会听众逐项进行讲解,并引出了涉外民事诉讼管辖与涉外劳动关系准据法适用问题的分析。最后,由汪卫平紧紧围绕着柬埔寨劳动用工法律风险管理问题,先从法律风险管理通用部分入手,介绍了法律风险管理的目的和宗旨、灵魂和统帅、要素、原则、流程和几个辩证关系,再就驻柬滇企柬埔寨劳动用工的具体问题,提出了底线意识和红线意识、审慎管理原则、执法力度的理解、法律服务资源获取等7个方面的建议,得到了与会人员的热烈反响。

本次柬埔寨劳动法律培训为云南弘石律师事务所走出国门开展的首单涉外业务。弘石律所组建了以汪卫平、桂进莫、张川、刘力铭、惠乾为成员的项目组对培训进行专项推进。在培训项目启动时,弘石律所与培训主办方紧密配合,就培训需求向拟参加培训企业开展了深度调研,后根据调研结果进行需求导向的精心准备。在准备过程中,就法律规定及文本差异进行了细致推敲和严密论证,并就部分问题获得了柬埔寨当地律师的专业支持。在培训正式开展前,项目组编制了云南弘石律师事务所及磨憨分所柬埔寨劳动法咨询服务问题清单,并建立了培训微信群,为企业提供优质的法律咨询,保障培训效果。整个培训项目的落地实施,得到了云南省驻柬埔寨(金边)商务代表处和中国国际贸易促进委员会云南省分会、云航投(柬埔寨)机场管理有限公司的大力支持、帮助。

弘石律所通过开展本次培训,展示了自身的专业素养和专业形象,并切实提升了涉外业务的办理经验,加深了对澜湄五国法律服务市场的理解,提升了以提供柬埔寨劳动法律服务以及老缅泰越劳动法律服务为突破口、打开涉外法律服务市场新局面的信心。

News |G-stone Law Firm Completed Cambodian Labor Laws Training for Yunnan Enterprises in CambodiaOn December 23, 2023, at the site of Yunnan Airinvestment (Cambodia) Airport Management Co.,Ltd. in Siem Reap Province, Yunnan G-stone Law Firm's Wang Weiping and Hui Qian successfully completed the training on the theme of "Comparative Study of Chinese-Cambodian Labor Laws and Discussion on Legal Risk Management of Labor Employment for Yunnan Enterprises in Cambodia."This training was organized by the Yunnan Commercial Representative Office in Cambodia (Phnom Penh) and the China Council for Promotion of International Trade Yunnan Sub-Council, and hosted by Yunnan G-stone Law Firm and Yunnan Airinvestment (Cambodia) Airport Management Co.,Ltd.At the opening of the training, Liu Xiao, Director of the Yunnan Commercial Representative Office in Cambodia (Phnom Penh), Li Rengui, Secretary-General of the China Council for Promotion of International Trade Yunnan Sub-Council, and Wang Weiping, Director of Yunnan G-stone Law Firm, delivered speeches. The training was conducted simultaneously in Phnom Penh and Kunming through an online meeting, with other members of the G-stone Law Firm training team participated in the Kunming online conference.In the main lecture session, Wang Weiping, as Committee Expert of South and Southeast Asia Legal Service Center of Trade, and Hui Qian, as Wang Weiping’s assistant, served as the main speaker or assistant speaker for this training. They focused on the reasons, principles, and an overview of Cambodian Labor Law, specific provisions of Cambodian Labor Law in two modules and one issue, and the discussion of legal risk management of labor employment. First, Wang Weiping explained to the audience why such an exchange and discussion took place, based on the needs of the domestic and international economic circulation, the deepening of the "Belt and Road" initiative, the need of people-centered legal risk management, and the need to deepen the traditional friendship between China and Cambodia. It was the right time to conduct this training. Secondly, Wang Weiping lectured on the overview of the Cambodian Labor Law, the Chinese Labor Law, and the Chinese Labor Contract Law, as well as the comparative structure of labor laws between China and Cambodia. Next, Wang Weiping discussed the need for repeated verification in the study and research of foreign laws, the persistence and interaction during the training process, and why this training should be conducted as an expert rather than a lawyer. When discussing the need for repeated verification in the study and research of foreign laws, they cited the example of the verification process by G-stone Law Firm to comprehend the specific provisions of Cambodian Labor Law on night and night shift work  by comprehensive verification from different sources and languages. These topics stimulated strong interest among the audiences. Afterwards, Hui Qian explained to the audience, step by step, the provisions of Cambodian Labor Law regarding the establishment, performance, suspension, and termination of labor contracts, important provisions on labor protection, and the resolution of labor disputes, which led to an analysis of the issues of jurisdiction in foreign civil litigation and the application of the law in foreign labor relations. Finally, Wang Weiping focused on the legal risk management of labor employment in Cambodia, starting with the general part of legal risk management. He introduced the purpose and principles, the soul and commander, elements, principles, processes, and several dialectical relationships of legal risk management. Then, regarding the specific issues of labor employment for Yunnan enterprises in Cambodia, he proposed seven recommendations, including bottom-line awareness and red-line awareness, prudent management principles, understanding of enforcement intensity, and obtaining legal service resources. These suggestions received enthusiastic responses from the participants.This training on Cambodian labor laws is the first overseas business conducted by Yunnan G-stone Law Firm. G-stone Law Firm formed a project team with members including Wang Weiping, Gui Jinmo, Zhang Chuan, Liu Liming, and Hui Qian to advance the training. At the start of the training project, G-stone Law Firm closely cooperated with the organizers, conducting in-depth surveys on the training needs for participating enterprises, and then carefully preparing based on the survey results. During the preparation process, G-stone Law Firm made detailed and rigorous analyses of legal provisions and textual differences, and obtained professional support from local lawyers in Cambodia. Before the formal start of the training, the project team compiled a list of questions about labor law consulting services in Cambodia for Yunnan G-stone Law Firm and Mohan Branch, and established a training WeChat group to provide high-quality legal consultations to enterprises, ensuring the effectiveness of the training. The implementation of the entire training project received strong support and assistance from the Yunnan Commercial Representative Office in Cambodia (Phnom Penh), the China Council for Promotion of International Trade Yunnan Sub-Council, and Yunnan Airinvestment (Cambodia) Airport Management Co.,Ltd.Through this training, G-stone Law Firm showcased its professional competence and image, effectively enhanced the handling experience of overseas business, deepened its understanding of the legal service market in the Lancang-Mekong five countries, and boosted confidence in opening up new prospects in the overseas legal service market, by focusing on providing legal services in Cambodian labor laws and labor laws of Laos, Myanmar, Thailand, and Vietnam.
