2023年5月24日至6月1日，我到老挝及中国磨憨法务考察。现将此行所见闻所感分享出来，对老挝及磨憨情况尚不熟悉的法务及商务人员进行法务或商务活动，可以参考；也请熟悉相关情况的大家批评指正。


一、签证办理总体方便，期待后续更加便捷。
    此次出行系以参加在老挝琅勃拉邦举办的兰迪海外投资论坛为契机。到琅勃拉邦系乘坐中老国际列车，不能办理落地签，到老挝的签证系委托兰迪昆明律所小吴老师办理，签证费用200元人民币，四天以后才能办好取证，加急办理需要增加费用。在此对兰迪昆明及小吴老师表示衷心感谢。
目前的签证办理总体感觉还算方便。但期待后续能够实现乘坐中老国际列车出入境能够实现落地签；当然能够免于签证最好不过。



二、乘坐中老铁路动车出行非常方便，但美中仍有不足。 
    国际列车开行之前乘坐动车到老挝，需要在磨憨出站，在磨憨口岸通关出境，到磨丁口岸通关入境，再到磨丁车站上车，分段乘车。国际列车开行后再到老挝，除了选择沿袭之前的分段乘车方式之外，最佳选择乘坐中老铁路国际列车在磨憨、磨丁站内办理通关手续到老挝。美中不足的是，办理通关手续，乘客需要下车并携带所有行李物品下车，在车站内通关，而非在车厢内、在座位上办理通关手续，并且在磨憨车站和磨丁车站的两次通关，时间分别为90分钟，合计180分钟，耗时过长。顺便交代一句，在磨憨出境通关完成后，乘客重新进站上车，原位乘车12分钟到达磨丁车站，下车进站办理入境老挝通关手续。



三、住宿条件尚可，务实求真实用。
    论坛主办方统一组织到琅勃拉邦西双版纳大酒店住宿。房间分为景观房62美金，新楼52美金，老楼42美金。我内心倾向于住老楼省点钱，把省下来的钱用于安排团队成员多出境、出省考察学习。我从琅勃拉邦乘坐老挝境内列车到达万象时，驻万象客户代表询问我要住条件更好的万象地标酒店还是他们常住的酒店。为了工作上的便利，当然也为了省钱，我毫不犹豫地选择入住客户代表常住酒店。在万象四天三晚，均住宿该酒店，感觉尚可，费用合理。为陪同跨境电商协会成员单位工作人员到琅勃拉邦商务谈判，在琅勃拉邦又住了一晚，在谷歌地图上选取一家叫Merry Riverside Hotel的酒店入住，相当于国内的客栈或民宿那种，小家碧玉，清幽典雅，房费非常合理。感兴趣前往体验的朋友，可以到我个人视频号里点击观看。



四、法务商务活跃，成熟起步并存。 
    从这次兰迪海外投资法律论坛的成功举办，从与参加论坛相关人员的沟通交流，从对驻老挝万象客户代表的访谈结果，从参加云南省跨境电商协会及成员单位商务考察、商务谈判的观察了解，目前中国境内律所到老挝法务考察或从事法律服务，境内企业、个人到老挝商务考察、商务谈判、投资、贸易或从事建设工程等经贸活动，异常活跃。其中，正在起步者或稳健经营者，均有相当可观的数量。反过来，在中国老挝磨憨-磨丁经济合作区，亦有老挝、泰国的物流企业设立了办事机构。



五、使用几个小程序，融入当地网络生活。
    从昆明到琅勃拉邦的火车票，用12306即可线上购买，但要换取纸质车票；回程的国际列车，一旦跨境乘车，也要纸质车票。老挝国内乘车，通过购票软件买票的，像国内一样，凭电子车票乘车，而无须获取纸质车票。从琅勃拉邦到万象的火车票，我请已在老挝工作的律师同行帮我线上购票，因处于非营业时段而不能购买。我只好提前到达车站，排队购买。 
    在万象期间，我下载了老挝境内使用的火车票购票软件LCR Ticket，使用老挝境内电话号码注册成功。从此我就可以像在国内使用12306一样方便地在老挝查询中老铁路车次和购买车票了。
在万象期间，我下载谷歌地图以后，就可以正常使用导航，自由行走于万象的大街小巷了。那天，装备齐整，正准备跑步到万象中心的时候，用华为运动APP准备跑前热身时，发现网络异常。经求助酒店大堂工作人员，给手机充值续费后，还要订制流量包。流量订制以后，又可以跑前热身，又可以记录跑步数据并可以使用谷歌地图导航了。从万象中心折返酒店过程中，完成预定的跑步距离6.6公里，做完拉伸以后，已经是下午三点了。找了一家路边小吃店，吃碗面条，喝杯啤酒，也很惬意。就在此时，问题来了，手机没电关机，充电宝没带，店家的充电线插头不匹配。只有无导航模式回酒店了。可是，我的方向判断失误，我最终迷失了方向。遇不到会讲汉语的人问路，我又不会老挝语。好不容易遇到一对美国情侣，按照其帮我导航指明的方向行走三条道路以后，我又再次迷路了。这一次，会讲英语的人也遇不到了。无奈进到一家餐饮店，要了一根充电线给手机充电。因为后续行程的时间限制，充电至15%以后，匆匆上路回酒店。连走带跑快到酒店的时候，手机又二次失电了。因为离酒店很近，终于无导航模式走回酒店了。在语言不通的情况下，出门到达自己不熟悉的地段，必须要确保手机有电，网络畅通。
    如果网络畅通，问路也好，购物也罢，要做一些简单的交流，就有办法了。通过谷歌翻译软件，可以以文字或语音方式，在英语和汉语之间，或汉语与老挝语之间，同步实现机器翻译，翻译准确率较高，基本能够实现有效沟通。



六、着装应该更正式，更加注重商务礼仪。
     这次到老挝，一共参加了三次比较正式的法务或商务活动。一次是在琅勃拉邦参加兰迪海外投资法律论坛，一次是在万象参加云南省跨境电商协会对当地合作伙伴的参观考察，一次是陪同协会成员单位工作人员参与与当地潜在合作伙伴的商务谈判。前两次活动，老方人员均西装领带，非常正式。此后再到老挝从事法务、商务活动，我也会带上一套西服，入乡随俗，对等着装，体现必要的商业礼仪。



七、入乡随俗，脱鞋进屋。
     在琅勃拉邦时，准备进入一家街边药店时，看到门口摆着鞋子，看到出店人员出门穿鞋走人。由于拿不准并且不适应，我穿鞋进入药店，但如坐针毡，备感不适，站在门边不敢随意走动。在万象参与商务谈判时，进入公司办公室前，根据公司工作人员的指引，便很自然地脱鞋放到门口，只穿袜子进入公司二楼会议室了。会议期间回到一楼使用卫生间，也是一尘不染，滴水不漏，赤脚出入卫生间。当然，主人也准备了室内拖鞋，供选择使用。返回琅勃拉邦入住Merry Riverside Hotel酒店，从室外步入前台之处，便设有鞋架，也是要求脱鞋进入酒店。两次脱鞋进屋，入乡随俗，并无任何不适之感。一是因为我并不脚臭，二是我每天更换袜子。



八、防寒保暖，避免感冒。 
    由于室外温度高达34、36、38，而进入酒店、餐厅、办公室、乘用车辆以后，空调温度极低，导致室内外温差异常加大。这种情形，用“冰火两重天”形容，并不为过。对于我这种对低温极其敏感、耐寒力严重不足的人，很容易感冒。事实上，这次老挝之行，我就是健康着出去，感冒着回来，应该是此行的唯一遗憾之事了。这样的结果，还是我在进入室内或车内，比较及时地穿上随身携带的外套以后所发生，真是防不胜防啊！当然，贪杯著名的老挝冰啤酒，那是我咎由自取。




B&R丨 Essay on Legal Fieldwork in Laos and Mohan, China
   From May 24 to June 1, 2023, I went to Laos and Mohan, China for a legal service fieldwork. I would like to share what I saw, heard and felt on this trip for the reference of legal and business people who are not yet familiar with the situation in Laos and Mohan for their legal or business activities, and welcome the criticism and correction of those who are familiar with the situation.
I. Visa processing is generally convenient, and looking forward to more convenient follow-up.
This trip took the opportunity of attending the Landing Overseas Investment Forum held in Luang Prabang, Laos. I took the China-Laos international train to Luang Prabang, and couldn’t handle the landing visa. The visa to Laos was handled by Miss. Wu of Landing Kunming Law Firm with 200 RMB per person, and it will take four days before the visa is ready for collection. I would like to express my heartfelt thanks to Miss. Wu and Landing Kunming Law Firm.
The overall feeling of the current visa processing is quite convenient. However, I look forward to the subsequent realization of visa-on-arrival by China-Laos international train; of course, it is best to be exempted from visa.



II. Travel by China-Laos Railway high-speed train is quite convenient, but shortcomings are still existing.
If you want to go out to Laos by high-speed train before the starting of international trains, you need to leave Mohan Railway Station, clear customs at Mohan Port to leave China, clear customs at Boten Port to enter Laos, and then get on the train at Boten Railway Station, anyway, taking the train in sections are necessary. After the starting of the international train, if you need to go to Laos again, in addition to choose to follow the previous section of the way, the best choice is to take the China-Laos international train in the Mohan, Boten railway stations for customs clearance to Laos. The shortcoming is that passengers need to get off the train with all their belongings and clear customs at the station, instead of clearing customs on the seat, and the two customs clearances at the Mohan and Boten railway stations would take 90 minutes respectively, totaling 3 hours, which is time consuming. By the way, after the outbound clearance in Mohan, passengers need to re-enter the train and took the same seat for 12 minutes to arrive at Boten Railway Station, and got off the train to enter the station for customs clearance in Laos.



III. Accommodation conditions are acceptable with pragmatic, real and simple attitude.
The forum organizer unified us to Luang Prabang Xishuangbanna Hotel for accommodation. The rooms are divided into a landscape room at 62 USD, a new building at 52 USD and an old building at 42 USD. I was inwardly inclined to pay for one room in old building to save some money to arrange more outbound and other provinces’ fieldwork for team members. When I arrived in Vientiane by train from Luang Prabang, the client representatives in Vientiane asked me if I wanted to book Vientiane’s landmark hotel, which was in better condition, or their usual hotel. For the convenience of my work and of course to save money, I did not hesitate to book the client representatives’ usual hotel. I stayed at this hotel for four days and three nights in Vientiane, and felt it was okay and the cost was reasonable. In order to accompany the staff of the cross-border e-commerce association to Luang Prabang for business negotiation, I stayed in Luang Prabang for another night and chose a hotel called Merry Riverside Hotel on Google Maps, which is equivalent to a domestic inn or auberge. The hotel is bijou, quiet and elegant, with a quite reasonable cost. If you are interested in going to experience it, please click to watch it in my personal WeChat Channels.



IV. Legal and business activities are active, with both maturity and start-up.
From the successful holding of the Landing Overseas Investment Legal Forum, from the communication with the participants of the forum, from the results of the interviews with the client representatives in Vientiane, Laos, and from the observation and understanding of the business visits and business negotiations of Yunnan Cross-border E-Commerce Association and its members, the law firms in China are visiting Laos for legal fieldwork or engaging in legal services, and the domestic enterprises and individuals are visiting Laos for business visits, business negotiations, investment, trade or construction works are exceptionally active. Among them, there are a considerable number of those who are starting up or steady operators. In turn, logistics companies from Laos and Thailand have set up offices in China-Laos Mohan-Boten Economic Cooperation Zone.



V. Use several mini programs to integrate into local network life.
Train tickets from Kunming to Luang Prabang can be purchased online by using 12306, but you have to exchange them for paper tickets. Paper tickets are also required for the return international train once you cross the border. For domestic travel in Laos, passengers who purchase tickets through the ticketing software, like in China, travel with electronic tickets without obtaining paper tickets. For the train ticket from Luang Prabang to Vientiane, I asked a lawyer who is already working in Laos to purchase the ticket for me online, but we could not do so because it was out of business hours. I had to arrive at the station early and stand in line to purchase ticket.
While in Vientiane, I downloaded LCR Ticket, a train ticketing software used in Laos, and successfully registered by using a phone number in Laos. Since then, I could reference the schedule of trains and buy tickets in Laos as easily as use 12306 in China.
During my time in Vientiane, I downloaded Google Maps and was able to navigate the streets of Vientiane normally and freely. That day, when I was fully equipped and ready to run to Vientiane Center, I found that the network was abnormal while using Huawei Sports App to warm up before the run. After asking for help from the hotel lobby staff, I had to subscribe to a data package after topping up my phone. After the package subscription, I was able to warm up before running, record the running data and use Google Maps to navigate again. During the return trip from Vientiane Center to the hotel, I finished the scheduled running distance of 6.6km and after stretching, it was already 3pm. I found a roadside snack bar and had a bowl of noodles and a glass of beer, which made me very pleasant. At this point, the trouble came, my phone was out of power, the rechargeable battery was not carried, the store’s charging cable plug did not match. I had to go back to the hotel without navigation. However, my directional judgement was wrong and I finally lost my way. I couldn’t meet anyone who speaks Chinese to ask for directions, while I don’t speak Lao. After meeting an American couple and after following the directions they gave me for three roads, I was lost again. This time, I couldn’t meet anyone who speaks English either. I had no choice but to go into a luncheonette and asked for a charging cable to charge my phone. Because of the time limit for the rest of the trip, I charged it to 15% and hurried back to the hotel. When I approached the hotel, my phone run out of its power for the second time. Because the hotel was very close, I finally walked back to the hotel without navigation. In the case of language barrier, when you arrive at a location you are not familiar with, you have to make sure your phone is charged and the network is obtained.
If the network is available, ask for directions or shopping, to do some simple communication, there is a way. Through Google Translate software, you can synchronize machine translation between English and Chinese, or between Chinese and Lao, in text or voice, with high translation accuracy, which basically enables effective communication.



VI. The dress should be more formal and pay more attention to business etiquette.
During this visit to Laos, I participated in a total of three formal legal or business activities. Once in Luang Prabang to participate in the Landing Overseas Investment Legal Forum, once in Vientiane to participate in the visit of Yunnan Cross-border E-Commerce Association to local partners, and once to accompany the staff of the association member to participate in business negotiations with potential local partners. In the first two events, the Lao party staff were all suit and tie, which are very formal. After that, when I go to Laos again to engage in legal and business activities, I would also bring a suit and dress reciprocally to follow the customs and show the necessary business etiquette.



VII. When in Rome do as the Romans do, take off your shoes to enter the house in Laos.
When I was preparing to enter a street pharmacy in Luang Prabang, I saw shoes placed at the door and saw people leaving the store wearing the shoes. Because I was not sure and not adapted, I entered the pharmacy with my shoes on, but I was on pins and needles, so I stood at the door and did not dare to walk around. But when I was involved in a business negotiation in Vientiane, I naturally took off my shoes and put them at the door before entering the company’s office according to the guidance of the company staff, and entered the meeting room on the second floor wearing only socks. When I returned to the bathroom on the first floor during the meeting, it was also spotless and leak free, and I went in and out of the bathroom barefoot. Of course, the host has also prepared indoor slippers for choose. When I returned to Luang Prabang and entered the Merry Riverside Hotel, there was a shoe rack at the front desk from outside, and I was also asked to take off my shoes to enter the hotel. I took off my shoes twice and did not feel any discomfort, because I don’t have smelly feet and I change my socks every day.



VIII. Keep warm and avoid catching a cold.
Because the outdoor temperature was as high as 34, 36, 38℃, the air conditioning temperature was extremely low when entering the hotel, restaurant, office, and passenger vehicle, it resulted in an abnormal increase indoor and outdoor temperature differences. It is not too much to describe this situation as "the amalgamation of ice and fire". For me, who is extremely sensitive to low temperature and has a serious lack of cold tolerance, it is very easy to catch a cold. In fact, during this trip to Laos, I went out with a healthy body, but came back with a cold, which should be the only regret of this trip. Even if I put on my portable jacket in a timely manner when entering the room or car, such a result still happened, which really hard to prevent! Of course, I was accountable for my voracity for the famous iced beer of Laos.
