【项目介绍】
    2022年7月，受管委会委托，弘石律所法风管团队承接“国际法律服务综合体建设与中央法务区建设的融合与发展问题研究”课题，2022年11月项目成果按照合同约定交付并通过验收。弘石律所项目团队基于课题需要，在项目开展过程中，充分收集文献资料，开展数据分析，并通过走访调研，深入调查国际法律服务综合体的现状，并到其他先进地区中央法务区调研，学习先进经验，针对国际法律服务综合体的特性进行总结、吸收，在项目研究报告中提出了切实可行的建议，助力委托人国际法律服务综合体建设水平的提升。

 

    为保障本项目的顺利推进，法风管团队采取了以下措施：

一是强有力的队伍保障。法风管团队自2009年成立以来，承接过大量、各类型的研究课题，形成了丰富的课题研究经验和心得体会，能够确保项目成功。在本项目中，法风管团队成立了课题研究项目团队，项目团队由3名执业律师及1名律师助理组成，3名执业律师均具有同类项目丰富经验，各项目团队成员能够分工协作、密切配合。同时，为提升项目相关方管理水平及本项目的附加值，弘石项目团队邀请了委托人相关工作人员一同组成联合调研团队开展调研，保障调研工作达到预期目标。

    二是广泛收集、分析资料，开展对比研究。项目团队大量收集了全国范围内关于法律服务聚集区建设的法律、法规、规章、规范性文件、标准、论文期刊、新闻、案例等文献资料，并进行分析、整合，形成了项目数据库。此外，项目团队将中央法务区和国际法律服务综合体进行对比研究，提出国际法律服务综合体借鉴中央法务区先进经验的可行性，并总结出两者的异同，为项目的推进打下良好的基础。

三是项目团队坚持实践研究方法，确保研究成果的时效性、准确性、可用性。自承接课题以来，项目团队展开了三个阶段的调研，第一阶段围绕国际法律服务综合体本地线下实体平台开展调研走访，从而直观地了解国际法律服务综合体建设现状以及不足之处，合理确定下一步调研工作重点。第二阶段赴广州湾区中央法务区、海丝中央法务区进行实地走访调研，学习相关调研对象的先进经验。第三阶段的调研则以问卷形式收集国际法律服务综合体相关服务对象的意见，即调查相关服务对象对国际法律服务综合体的评价及需求。通过多阶段、分层次、有目标地开展调研，确保了研究成果的时效性、准确性、可用性。

 

    本课题研究项目经过四个月的潜心研究，形成了《国际法律服务综合体建设与中央法务区建设的融合与发展问题研究课题报告》。

课题报告内容主要包括四个方面：第一，总结出了国际法律服务综合体当前发展的主要问题；第二，对比国际法律服务综合体与中央法务区，提炼出中央法务区可借鉴的先进经验；第三，收集分析了国际法律服务综合体服务对象的主要需求与建议；第四，结合各阶段成果，提出提高国际法律服务综合体建设水平的建议，内容涉及体制机制搭建、人才培养、业务推广、政策制定等。

 

    面对“一带一路”合作倡议持续推进、RCEP落地施行、昆明托管磨憨等机遇，发展国际法律服务综合体正当其时，国际法律服务综合体作为具有前瞻性、首创性、国际性的法律服务聚集区，有利于提升委托人辖区公共法律服务能力、优化辖区营商环境。但由于法律服务聚集区在全国范围内仍然属于新生事物，与本课题同类或近似的研究成果较少，因此本课题的研究具有明显的创新性与现实性。本项目研究成果帮助委托人掌握当前国际法律服务综合体存在的迫切需要解决的不足，并进行了成因分析。同时，项目成果就国际法律服务综合体与中央法务区进行对比研究，借鉴中央法务区先进经验对发展国际法律服务综合体提出了具体建议，对于更好发挥国际法律综合体的法治效应、社会效应提供了有益的帮助。

 

I.Project IntroductionIn

    July 2022, entrusted by a management committee, the legal risk management team of G-stone Law Firm undertook a project on "Research on the Integration and Development of the International Legal Service Complex and Central Legal District’s Construction". In November 2022, the project’s result delivered and accepted as agreed in accordance with the contract. The project team collected relevant literature, conducted data analysis, visited and researched the current situation of International Legal Service Complex, and visited other advanced regions’ central legal district, learned advanced experiences, summarized and absorbed the characteristics of International Legal Service Complex, and made practical recommendations in the project research report, so as to assist the client in improving the construction of International Legal Service Complex.

 

     In order to ensure the smooth progress of the project, the legal risk management team had taken the following measures:

Firstly, a strong team is in place. Since established in 2009, the team has undertaken a number of research projects of various types, and has developed rich experiences and insights in research, which could ensure the success of the project. In this project, the team had set up a project team consisting of three practicing lawyers and one paralegal, all lawyers have extensive experience in similar projects and could collaborate closely. At the same time, in order to improve the management level of the relevant parties and the added value of this project, the G-stone project team invited the relevant staff of the client to form a research team together to carry out the research so as to ensure the research could achieve the expected objectives.

      Secondly, we collected and analyzed a wide range of information and conducted comparative studies. The project team collected a large amount of literature on laws, regulations, rules, normative documents, standards, journals, news, cases and other materials on the construction of legal service gathering areas nationwide, and integrated to form the project database. In addition, the project team conducted a comparative research between the Central Legal District and the International Legal Service Complex, proposed the feasibility of the International Legal Service Complex to learn from the advanced experience of the Central Legal District, and summarized the similarities and differences, which laid a good foundation for the advancement of the project.

     Thirdly, the project team insisted on practical research methods to ensure the timeliness, accuracy and usability of the research results. Since taking up the project, the team has conducted three stages of research. In the first stage, the team conducted research visits around the entity platform of the International Legal Service Complex, so as to take fully aware of the current situation of the construction and shortcomings, so that reasonably determine the focus of the next stage research. In the second stage, the team had visited the Guangzhou Bay Area Central Legal District and the Maritime Silk Road Central Legal District to field research and learn from the advanced experience of relevant research recipients. The third stage of the research was to collect the opinions of the relevant service recipients of the International Legal Service Complex in the form of questionnaires. In other words, the third stage was to investigate the evaluation and needs of the relevant service recipients. Through multi-stage, hierarchical and targeted research, the timeliness, accuracy and usability of the research results were ensured.

      After four months of dedicated research, the project team had completed the research report on " the Integration and Development of International Legal Service Complex and Central Legal District Construction".

      The report mainly covered four aspects: a. It summarized the main problems of the current development of International Legal Service Complex; b. It compared the International Legal Service Complex with the Central Legal District and distilled the advanced experience from the Central Legal District; c. It collected and analyzed the main needs and suggestions of the service recipients of International Legal Service Complex; d. In light of results of the various stages, suggestions were made to improve the construction of the International Legal Service Complex, covering the establishment of institutional mechanisms, talent training, business promotion and policy formulation.

     Faced with the continuous promotion of the "Belt and Road" cooperation initiative, the implementation of the RCEP and the hosting of Mohan by Kunming, it is timely to develop International Legal Service Complex, which, as forward-looking, innovative and international legal service gathering areas, is conducive to enhancing the public legal service capacity of the client's jurisdiction and optimizing the business environment of the jurisdiction. However, as legal service gathering areas are still new around the nation, there are few similar research results with this project, so the research is obviously innovative and realistic. The research results will benefit the client to grasp the urgent shortcomings that need to be addressed in the current International Legal Service Complex, and conduct causes analysis. At the same time, the results which compared the International Legal Service Complex with the Central Legal District, have made specific suggestions to improve the construction of the International Legal Service Complex by learning the advanced experience from the Central Legal District. The results of the project will provide beneficial assistance to bring into better play with the legal and social effects of the International Legal Complex.
