弘石简讯(双语)/昆明经济开发区制度创新与云南弘石律师事务所开展RCEP学习交流

    为助力昆明经济技术开发区暨中国(云南)自由贸易试验区昆明片区日趋活跃的国际商贸活动,更好地为辖区相关企业提供RCEP学习培训与应用指导,2023年1月13日,昆明经济技术开发区制度创新部特邀云南弘石律师事务所开展“进出口企业如何从RCEP中寻找机会和效益”为主题的学习交流。制度创新部法制科科长潘晓鹏,弘石律所副主任、合伙人、法律风险管理团队负责人汪卫平及双方其他相关人员参与本次学习交流。
 

    主讲环节,弘石律所张川、惠乾作为本次学习交流的主讲人,围绕RCEP内容概要、企业值得重点关注的章节以及企业如何把握RCEP带来的效益和机会三大方面进行分享。首先,由张川对RCEP的概念、整体框架、学习RCEP的重要意义进行简要介绍。RCEP包括初始条款和一般定义,货物贸易,原产地规则,海关程序与贸易便利化,卫生与植物卫生措施,标准、技术和合规评定程序,贸易救济,服务贸易,自然人移动,投资,知识产权,电子商务,竞争,中小企业,经济与技术合作,政府采购,一般条款和例外,机构条款,争端解决,最终条款共二十个章节,内容较为繁复。其次,惠乾为大家解读了RCEP中与进出口企业密切相关的重点章节。基于目前国际商贸发展趋势、国家利好政策动向,以及中小企业如何利用RCEP谋求发展,惠乾选取RCEP“原产地规则”“电子商务”“中小企业”等章节着重分析。最后,张川针对“企业如何抢抓RCEP带来的机遇”问题,提出充分了解掌握与业务相关重点章节、积极拓展海外业务、善于利用官方信息渠道、寻求专业人士帮助等具体建议。

 

    交流环节,制度创新部与弘石律所就RCEP后续学习交流加以热切展望。潘晓鹏指出,此次分享简要介绍了RCEP总体框架,重点解读了与进出口企业密切相关内容,以RCEP相关条款为依据,观点清晰,讲解力求通俗易懂,帮助与会人员加深了对RCEP的了解,建议弘石律所进一步提升课件内容的趣味性、实践性和PPT页面的简洁性,针对不同的市场主体设计能够满足其不同需求的课件,为下一步面向企业开展RCEP系列学习活动做好充分准备。制度创新部其他参会人员也对课件的改进提出了中肯的意见和建议。张川、惠乾表示,将虚心听取与会人员意见建议,不断改进课件质量,使之与受众的实际需求更为贴近。汪卫平表示,法风管团队后续会根据不同的客户研发不同的课件,精准满足特定客户的特定培训需求。此外,弘石律所与在RCEP、海关相关业务领域具有丰富实践经验的上海传铂律所签订了战略合作协议,合作双方已经作出初步安排,根据客户需求,传铂律所可以现场或远程方式,与弘石律所共同提供RCEP专业培训。
 

    RCEP整体生效已逾一年,除菲律宾尚未批准对其生效外,目前十五个成员国中已经有十四个国家批准对其生效。根据RCEP安排,成员国间关税逐步下降,贸易投资便利化程度逐渐提高,给区域经济增长已经切实带来了可观红利。如何抓住RCEP带来的效益与机遇,是行政机关及企业面临的重要课题。弘石律所积极响应一带一路倡议,努力提升涉外法律服务能力,满足客户涉外法律服务需求,立足云南对外开放前沿,以RCEP相关业务为研究重点之一,不断开拓创新,致力于为境内企业“走出去”、为境外企业到境内投资、贸易提供专业、优质、高效法律服务。

News| Institutional Innovation Department of Kunming Economic and Technological Development Zone and Yunnan G-stone Law Firm carry out learning and communication around RCEP
 
    To help the increasingly vibrant international business activities of Kunming Economic and Technological Development Zone & Kunming Area of China (Yunnan) Pilot Free Trade Zone, and better provide RCEP learning, training and application guidance for relevant companies under its jurisdiction, on January 13, 2023, the Institutional Innovation Department of Kunming Economic and Technological Development Zone specially invited Yunnan G-stone Law Firm to carry out a learning communication on the theme of "How Import and Export Companies Seek Opportunities and Benefits from RCEP?". Pan Xiaopeng, head of the Legal Section of the Institutional Innovation Department, Wang Weiping, deputy director and partner of G-stone Law Firm, head of the legal risk management team, and other members from both sides participated in the study and communication.
    In the keynote segment, Zhang Chuan and Hui Qian, as the keynote speakers of this study and communication, shared the contents of RCEP, the key chapters for companies and how companies grasp the benefits and opportunities brought by RCEP. First of all, Zhang Chuan briefly introduced the concept, overall framework and the significance of learning RCEP. RCEP includes  20 chapters in total, with various and complex contents: initial provisions and general definitions; trade in goods; rules of origin; customs procedures and trade facilitation; sanitary and phytosanitary measures; standards, technology and compliance assessment procedures; trade remedies; trade in services; temporary movement of natural persons; investment; intellectual property; electronic commerce; competition; small and medium enterprises; economic and technical cooperation; government procurement; general provisions and exceptions; institutional provisions; dispute settlement; final provisions. Secondly, Hui Qian explained the key chapters in RCEP that are closely related to import and export companies. Based on the current trend of international trade development and favorable national policies, and how small and medium enterprises use RCEP to seek development, Hui Qian selected chapters such as "Rules of Origin", "Electronic Commerce" and "Small and Medium Enterprises" to analysis. Finally, Zhang Chuan put forward specific suggestions such as fully understanding and grasping the key chapters related to business, actively expanding overseas business, making good use of official information channels, and seeking professional help on "How to seize the opportunities brought by RCEP?"
    In the communication link, the Department of Institutional Innovation and G-stone Law Firm made a keen outlook on the follow-up learning and communication of RCEP. Pan Xiaopeng pointed out that this sharing briefly introduced the overall framework of RCEP, focusing on the content closely related to the import and export companies, based on the relevant provisions of RCEP, with clear views and easy-to-understand explanations, which helped the participants deepen their understanding of RCEP, and suggested that G-stone Law Firm should further improve the interesting and practical content of the courseware and the simplicity of the PPT page, design courseware that can meet different needs of different market entities, and make full preparation for the next step of carrying out RCEP series of learning activities for companies. Other participants from the Institutional Innovation Department also put forward pertinent opinions and suggestions on the improvement of courseware. Zhang Chuan and Hui Qian said that they would listen to the opinions and suggestions of the participants with an open mind and constantly improve the quality of the courseware to make it closer to the actual needs of the audience. Wang Weiping said that the legal risk management team will develop different courseware according to different customers in the future to accurately meet the specific training needs of specific customers. In addition, G-stone Law Firm had signed a strategic cooperation agreement with Shanghai Trans Bright Law Firm, which has rich practical experience in the business fields of RCEP and customs. The two parties have made preliminary arrangements that Trans Bright Law Firm can provide RCEP professional training with G-stone Law Firm on site or remotely according to the needs of customers.
    RCEP has been in effect for more than one year, except the Philippines, 14 of the 15 member countries have ratified its entry into force. According to the RCEP arrangement, tariffs among member countries have been gradually reduced and the degree of trade and investment facilitation has been gradually improved, which has actually brought considerable dividends to regional economic growth. “How to seize the benefits and opportunities brought by RCEP?” is an important issue faced by administrative organs and companies.
